Website Visitor Terms of Service Agreement

By using this site, you must first agree to the Terms of Service ("TOS") set forth below and to enter into an agreement with us based on such TOS, whether or not you sign up as a member ("Member"). If you disagree with any of the conditions of the TOS, do not use this site. We reserve the right to change the TOS at any time. Please read the TOS carefully and check back for changes to the TOS each time you use this site. Your continued use of this site following the posting of changes to the TOS means that you accept those changes.

We have tried to make the TOS fair and straightforward, but feel free to contact us if you have any questions or suggestions.

Creating Accounts

After you have purchased a collection kit, you will need to create a username and password. You agree to provide us with accurate, complete and at all times up to date information for your Accounts and keep your accounts safe. We may need to use this information to contact you. You’re responsible for your accounts and any activity on them. Also, you need to be at least 18 years old to use eGenderTest.

If you allow third parties to access eGenderTest's website through your username and password, you will defend and indemnify us for any third party claims arising from your User Content based upon or relating to such access and use. You agree to immediately notify eGenderTest of any unauthorized use of your password or account or any other breach of security. To protect your account, be sure to sign out from your account at the end of each session. eGenderTest shall not and will not be liable for any loss or damage arising from your failure to comply with this Section.

All materials and products provided by eGenderTest are strictly for informational purposes only. Clients should consult with their physician(s) regarding any health or medical needs. eGenderTest does not provide any legal advice, medical recommendations, diagnoses, and/or treatment of any disease or disorder.

eGenderTest reserves the right to refuse or discontinue services to anyone that may be using our product for gender selection purposes. If a client indicates that the eGenderTest test is being used for the purpose of gender selection, we will halt further processing of the sample and sever any contact with the customer. No refund will be provided.

Privacy and Disclaimer

The makers of eGenderTest respect every client's privacy. Our company does not share, sell, or distribute your information to third parties. Your personal information is used solely for ordering our services, and anything that is relevant to your order which may require information such as email, phone number, or address.

Site Security

When you visit the website, we may automatically collect IP addresses and site usage information from you. This information helps us evaluate how our visitors and customers use and navigate our site, including the number and frequency of visitors and subscribers to each Website page, and the length of their visits. Such information does not include personally identifiable information, such as your name or address; this site traffic information is not shared with third parties.

Online transactions are handled through scripting designed for order submittal with Secure Sockets Layer (SSL) encryption. Your personal information, including your credit card number, is transmitted across the Internet in an encrypted form, and decoded once it enters our internal database. This provides a reliable and confidential ordering environment for your security. Ordering via telephone or postal mail is also available.

Unsolicited Information

Unsolicited information, ideas, questions, comments, or suggestions sent to eGenderTest via email or otherwise will be deemed non-confidential and are not protected under our privacy rights. Such unsolicited disclosures shall become the exclusive property of eGenderTest and eGenderTest shall obtain the rights to such information or ideas for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products.

Material Posted Through The Service

eGenderTest does not guarantee to the client that the services provided by eGenderTest will meet the expectations of the client or that the products will be free from defects or free from errors. Furthermore, in no event shall eGenderTest or the client be liable to the other for any indirect, incidental, special, punitive, or consequential damages.

Provision of Services

1.1 eGenderTest makes no representation, express or implied, that the result of the DNA analysis is fit for any purpose other than for personal life-style information.

1.2 The DNA analysis provided by eGenderTest is prepared solely for the use of the client by whom the product was purchased and/or to whom the results are disclosed. A client is an individual who has made a purchase of a service/product provided directly or indirectly by eGenderTest.

1.3 All materials and products provided by eGenderTest are strictly for informational purposes only. Clients should consult with their physician(s) regarding any health or medical needs. eGenderTest does not provide any legal advice, medical recommendations, diagnoses, and/or treatment of any disease or disorder.

1.4 eGenderTest reserves the right to refuse or discontinue services to anyone that may be using our product for gender selection purposes. 1.5 In order to maintain the quality and accuracy of the services provided by eGenderTest, the test instructions must be followed precisely. Consequences of the Client's failure to follow eGenderTest instructions, whether intentional or accidental, are the responsibility of the Client, not eGenderTest.

1.6 The biological samples supplied to eGenderTest by the client may be unrecoverable due to the laboratory procedures required to extract DNA. Left over samples may be used for quality control purposes and testing. At the time of ordering, the customer has the option to request that left over sample not be used for quality control testing. In this case, any remaining sample will be destroyed according to state and local regulations.

1.7 eGenderTest shall not be held liable for any damages caused as a result of the use of the information or products purchased.

1.8 eGenderTest is not liable for any action that might be taken by users of the services purchased. By purchasing EGenderTest products, you agree to release, indemnify, and hold harmless all of its officers and employees form all liability for the use of the product(s) purchased.

The Client's Warranties and Indemnity

2.1 The client affirms that they are not using eGenderTest for gender selection purposes.

2.2 The client warrants that he/she is legally entitled to collect the biological samples and supply them to eGenderTest for analysis. Regulations in your state or country may remove this right; eGenderTest does not enforce state or country specific regulations.

2.3 The client warrants that he/she is legally entitled to possess the biological samples provided to eGenderTest.

2.4 The client will indemnify eGenderTest and keep eGenderTest fully indemnified against all costs, claims, demands, expenses and liabilities arising from a breach of the warranties in the previous statements.
